AND FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. IN NO
EVENT SHALL SYSTRAN BE LIABLE FOR ANY DAMAGES WHATSOEVER, AND IN PARTICULAR
SYSTRAN SHALL NOT BE LIABLE FOR SPECIAL, INDIRECT , CONSEQUENTIAL,
OR INCIDENTAL DAMAGES, OR DAMAGES FOR LOST PROFITS, LOSS OF REVENUE,
OR LOSS OF USE, ARISING OUT OF OR RELATED TO ANY SYSTRAN WEB SITE
OR THE INFORMATION CONTAINED IN IT, WHETHER SUCH DAMAGES ARISE IN
CONTRACT, NEGLIGENCE, TORT, UNDER STATUTE, IN EQUITY, AT LAW OR OTHERWISE.
Any information provided to SYSTRAN in connection with any SYSTRAN
website shall be provided by the submitter and received by SYSTRAN
on a non-confidential basis. SYSTRAN shall be free to use such information
on an unrestricted basis.
SYSTRAN prohibits the use of the SYSTRAN Logo as a "hot" link to any SYSTRAN Web Site for commercial purposes unless the establishment of such a link is approved by SYSTRAN.
Written Notice of Copyright Claims
Claims of infringement should be in writing and should be directed
to SYSTRAN as specified below in Section B. You should include the
following information in the written notice:
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed,
or if multiple copyrighted works at a single online site are covered
by a single notice, a representative list of such works at that site.
- Identification of the material that is claimed to be infringing
or to be the subject of infringing activity and that is to be removed
or access to which is to be disabled, and information reasonably sufficient
to permit SYSTRAN to locate the material.
- Information reasonably sufficient to permit the service provider
to contact the complaining party, such as an address, telephone number,
and if available, an electronic mail address at which the complaining
party may be contacted.
- A statement that the complaining party has a good faith belief
that use of the material in the matter complained of is not authorized
by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate, and
under penalty of perjury, that the complaining party is authorized
to act on behalf of the owner of an exclusive right that is allegedly
infringed.
Under the appropriate circumstances, SYSTRAN's policy is to remove
and/or to disable access from SYSTRAN to Web pages of repeat infringers,
to terminate subscribers who are repeat infringers, and to remove
and/or to disable access from SYSTRAN to Web pages as to which there
have been steps taken for the purpose of affecting SYSTRAN's search
results such as adding "meta-tags".
